Anti-Diversion / Quality Assurance Policy Statement
The Professional Products Division (PPD) of L’Oréal USA Distributes several professional hair care brands. These brands include Biolage, Kerastase, L’Oréal Professionnel, L’Oreal Technique, Matrix, Mizani, Pulp Riot, Pureology, Redken and Shu Uemura.
These hair care products are primarily sold to Professional Beauty Salons, Beauty Supply Companies, National Beauty Chains, licensed Stylists / Cosmetologists and select Authorized eCommerce platforms via an authorized distribution network. In these environments, the hair care products are often used in conjunction with professional use only chemical products and services that are only offered for sale to licensed cosmetologists, estheticians, beauticians and other individuals holding a technical license.
These premium retail hair care products are intended to be sold to the consumer and only in “home use” quantities. All authorized vendors (distributor, beauty supply, salon, stylist, eCommerce etc.) are contractually obligated to offer L’Oréal PPD retail hair care products only to customers and consumers and only in limited quantities.
“Diversion” is defined as “the redirection of goods outside of authorized channels.” Authorized vendors acknowledge that diversion of L’Oréal PPD products damages the reputation of the brands and the goodwill of the brand customers. Business relations between the brands and the authorized partners are also damaged by diversion. The failure of a vendor to abide by L’Oréal’s anti diversion policies may result in the separation of its business relationship with L’Oréal.
Authorized vendors of L’Oréal PPD agree not to remove, defeat or tamper with any Anti-Diversion / Quality Assurance codes applied to the hair care products by the manufacturer. Authorized vendors also agree not to sell any hair care products to collectors, diverters or product redistributors and will not transfer any products if a suspicion of redistribution exists.
